Oceanside City Council Agrees to Explore Hybrid Rent Control & Tenant Protections
At Wednesday evening’s hearing, the Oceanside City Council heard hours of testimony both in favor and opposition of additional tenant protections and rent control. SCRHA argued against the need for additional tenant protections beyond state law and stricter rent caps. SCRHA also pointed out that while the Tenant Protection Act (AB 1482) allows cities to adopt more protective just cause regulations, it doesn’t do the same for “Rent Stabilization” and that any attempt to further cap rents would mean a local ordinance governed by Costa-Hawkins. SCRHA also reminded the council that local rent control means a whole new bureaucracy and that 60% of Oceanside voters rejected Prop. 33. In the face of all proposals going nowhere, Deputy Mayor Joyce and Councilmember Figueroa offered concessions that Councilmember Peter Weiss unfortunately agreed to after initially being opposed to most ideas. Joyce agreed to stick to state-mandated relocation and letting staff recommend when protections go into effect. He initially proposed day 1 of tenancy protections but capitulated so long as all rental properties are covered by the just cause protections. Figueroa also proposed rent control but only on properties owned by corporations, however, the City Attorney will have to look into the legality and definition of “corporation.” SCRHA is seeking clarification as the motion was not re-read and will also consult with the City Attorney on rent control proposal and definitions. SCRHA will update members as more information becomes available.

City of San Diego Trash Collection (Measure B) Hearing – Monday, April 14
The San Diego City Council is set to receive the Measure B staff report and vote on the Cost of Service Study this coming Monday. Measure B item is # 201:  Authorization to Set a Public Hearing Date Pursuant to Proposition 218 to Consider Adoption of a New Solid Waste Management Fee, Adopt Procedures for Submitting and Tabulating Protests Against the Proposed Fee, and Set Hearing Date to Consider Report of Proposed Fees to be Collected on the Tax Roll for the Forthcoming Fiscal Year, if Solid Waste Management Fee is Adopted
