10% Rent Cap in Effect as Storms Trigger Emergency & Price Gouging Rules
On January 4, 2023, Governor Newsom declared a State of Emergency due to winter storms. The statewide emergency is slated to be in effect through February 3, 2023. Price Gouging rules specific to rental housing are included.
Rent Increases are limited to no more than 10% during this time frame even for properties exempt from statewide rent caps. Additionally, newly set rents during the emergency are limited to no more than 10% over the last rental rate charged. Code § 396 sections (e) & (f) are applicable to rental housing and have very limited exemptions.
