2025 Forms Update
Below is a list of new and updated forms that owners and managers should be aware of. These forms have been updated to reflect new laws, as well as changes to Fair Housing and other regulations.
New Forms - December 2024
- #160ASM: Notice of Adverse Action-Active Service Member (SB611)
New Form to comply with SB 611, effective on April 1, 2025. It includes language to notify Services Members of higher deposit and the reason, as well as notice of the refund of the additional deposit within 6 months unless the tenant is in arrears. - #251C: Non-Smoking Areas Addendum (City of Carlsbad CS-475)
Beginning January 1, 2025, the City of Carlsbad bans smoking, including vaping and the use of cannabis in and around Carlsbad apartments, condos, townhomes and other multiunit homes. Mandatory language must be given to residents in affected properties.
Revised Forms - December 2024
- #100: Creating Your Rental Criteria (AB 2801 & SB 611)
Beginning January 1, 2025, rental housing providers will need to provide a copy of the rental criteria to applicants. The booklet includes information about developing rental criteria to comply with AB 2801 and SB 611. - #110: Application to Rent (AB 2493)
Application to Rent has been revised to include clean-up language, as well as to include language reflecting that as of January 1, 2025, a housing provider is required to provide a copy of the credit report to applicant within seven (7) days of receiving the report. - #200: Rental Agreements
All of the Rental Agreements, including City of San Diego, Chula Vista and general Rental Agreements, have been revised to include clean-up language and information about offering tenants an option of reporting positive rent payments. Offer to existing residents no later than April 1, 2025. (Does not apply to a rental building that contains 15 or fewer dwelling units, unless the owner owns more than one residential rental building and is a real estate investment trust, corporation, or LLC in which at least one member is a corporation.) - #272: Move-In Move Inspection Report (AB 2801)
Beginning July 1, 2025, housing providers are required to take photos of a unit just before or at lease singing. - #610: Itemization of Security Deposit (AB 2801)
Beginning April 1, 2025, housing providers are to take photos of a unit upon receiving possession and before any repairs are done. The law also requires housing providers to take photos after repairs are done.
